The Officer may suspend a permit if the holder fails to comply with the requirements of this chapter.

If a permit is suspended, the Officer shall notify the holder in writing. The notice must contain a statement informing the holder that a hearing will be provided if a written request for a hearing is filed by the holder with the Officer.

A person whose permit has been suspended may, at any time, apply for reinstatement of the permit. The application must contain a statement signed by the applicant that in the applicant’s opinion the conditions causing the suspension have been corrected. Within 10 days after receipt of a written request, an inspector shall make an inspection. If the applicant is complying with the requirements of this chapter, the permit must be reinstated.

After opportunity for a hearing, the Officer may permanently revoke a permit for serious or repeated violations of any of the provisions of this chapter or for interference with an inspector in the performance of the inspector’s duties. Before revoking a permit, the Officer shall notify the holder in writing, by certified mail, stating the reason for which the permit is subject to revocation and the requirements for filing a request for a hearing.

The Officer may permanently revoke a permit unless a request for a hearing is filed with the Officer by the holder of the permit within 10 days after service of notice.

6.

A hearing must be conducted by the Officer at a time and place designated by the Officer. The Officer shall:

(a)

Make a finding and may sustain, modify or rescind any notice or order considered in the hearing.

(b)

Furnish a written report of the decision to the holder of the permit.
