Investigation: Powers of health authority to access medical records, laboratory records and other information in possession of health care provider or medical facility

  • payment of certain costs related to investigation.

A health authority which conducts an investigation pursuant to NRS 441A.160 or 441A.163 shall, for the protection of the health, safety and welfare of the public, have access to all medical records, laboratory records and reports, books and papers relevant to the investigation which are in the possession of a provider of health care or medical facility being investigated or which are otherwise necessary to carry out the investigation. The determination of what information is necessary to carry out the investigation is at the discretion of the health authority.

If a health authority conducts an investigation pursuant to NRS 441A.160 or 441A.163, the health authority may require a provider of health care or medical facility being investigated to pay a proportionate share of the actual cost of carrying out the investigation, including, without limitation, the cost of notifying and testing patients who may have contracted an infectious disease, been exposed to a biological, radiological or chemical agent or otherwise been harmed.
