NRS 281A.685
Confidentiality of certain materials

  • no duty on Commission or staff to protect confidentiality of materials not in their possession
  • exceptions.

1.

Except as otherwise provided in this section, the following materials are confidential and are not public records pursuant to chapter 239 of NRS:

(a)

A request for an advisory opinion;

(b)

The advisory opinion rendered by the Commission in response to the request;

(c)

Any information, communications, records, documents or other materials in the possession of the Commission or its staff that are related to the request; and

(d)

Any information, communications, records, documents or other materials in the possession of the requester of the advisory opinion that are related to the request and, if disclosed by the requester, would reveal the existence, nature or content of the request or the advisory opinion.

The provisions of subsection 1 do not create or impose any duty on the Commission or its staff to protect or defend against the disclosure of any materials not in the possession of the Commission or its staff, regardless of whether the materials are related to the request.

The provisions of subsection 1 do not apply to any materials in the possession of the Commission or its staff that are related to the request if the requester of the advisory opinion:

(a)

Acts in contravention of the advisory opinion, in which case the Commission may disclose the request, the advisory opinion and any information, communications, records, documents or other materials in the possession of the Commission or its staff that are related to the request;

(b)

Authorizes the Commission, in writing, to make the request, the advisory opinion or any information, communications, records, documents or other materials in the possession of the Commission or its staff that are related to the request publicly available; or

(c)

Voluntarily discloses, in any manner, the request, the advisory opinion or any information, communications, records, documents or other materials in the possession of the Commission or its staff that are related to the request, except to:

(1)

The public body, agency or employer of the requester or the legal counsel of the requester;

(2)

Any person to whom the Commission authorizes the requester to make such a disclosure; or

(3)

Any person to whom the requester makes such a disclosure for the purposes of judicial review pursuant to NRS 281A.680.
