Initiation of request for advisory opinion

1.

A public officer or employee may file with the Commission a request for an advisory opinion to:

(a)

Seek guidance on matters which directly relate to the propriety of his or her own past, present or future conduct as a public officer or employee under the statutory ethical standards set forth in this chapter; or

(b)

Request relief pursuant to NRS 281A.410, 281A.430 or 281A.550.

2.

The request for an advisory opinion must be:

(a)

Filed on a form prescribed by the Commission; and

(b)

Submitted with all necessary information for the Commission to render an advisory opinion in the matter.

3.

The Commission may decline to render an advisory opinion if the public officer or employee does not:

(a)

Submit all necessary information for the Commission to render an advisory opinion in the matter; or

(b)

Declare by oath or affirmation that he or she will testify truthfully regarding the matter.
