NRS 639.2565
Reinstatement of suspended certificate.

A person whose certificate has been suspended by the Board may petition the Board for reinstatement of the certificate.

After receipt of the petition, the Board shall conduct a hearing to determine whether the certificate should be reinstated.

If a hearing is held, the Board may consider the results of its own investigation and any evidence pertaining to the competence of the petitioner. An affirmative vote of a majority of Board members is necessary to reinstate a certificate. The Board may require, prior to reinstatement, that the petitioner pass an examination, either oral or written, to determine the petitioner’s present fitness to resume practice.

In any hearing conducted under this section, the Board may employ any expert witnesses considered necessary to determine the competency and ability of the petitioner.

If the Board orders restoration of such certificate, it may waive the requirements of NRS 639.180, 639.190 and 639.2174.
