Sec. § 539.040
Informalities in petition to be disregarded; reason for refusal or dismissal of petition; mandamus.

In the hearing of any petition, the board of county commissioners shall disregard any informalities therein.

If the board of county commissioners deny the petition or dismiss it for any reasons on account of the provisions of this chapter not having been complied with, which are the only reasons upon which the board of county commissioners shall have the right to refuse or dismiss the petition, the board of county commissioners shall state its reasons in writing therefor in detail, which shall be entered upon its records.

If the reasons are not well founded, a writ of mandamus shall, upon proper application therefor, issue out of the district court of the county compelling the board of county commissioners to act in compliance with this chapter, which writ shall be heard within 20 days from the date of issuance, such time to be excluded from the time given the board of county commissioners to act upon the petition.
