Investigation by Administrator

  • disciplinary action.

1.

The Administrator may on his or her own motion, and shall upon receiving a complaint, investigate the actions of any licensee or any other person who assumes to act in the capacity of a licensee in this State. A complaint must be verified and filed with the Division within 2 years after the act complained of.

If the Administrator finds that the licensee or other person has acted in violation of this chapter, and that the violation is not repeated or continuing, the Administrator may attempt to secure a correction of the violation or satisfaction for the complainant from the licensee or other person. If the Administrator’s attempt fails or if the Administrator determines that disciplinary action is necessary, the Administrator may take disciplinary action.

If the Administrator finds that the violation is being repeatedly or continuously committed, or if in the Administrator’s discretion the violation warrants disciplinary action, the Administrator may take disciplinary action without seeking correction or satisfaction.
