Procedure at hearing

The hearing panel shall keep a record of the hearing and allow any disseminator or user to present oral or written testimony at the hearing.


At the hearing each interested disseminator shall present a proposal for the exclusive right to disseminate a live broadcast to users.


A user may present evidence in support of or in opposition to any proposal presented by a disseminator, except that a user may not offer an opinion as to which disseminator the panel should recommend to the Board.


Within 10 days after the hearing is completed, the hearing panel shall select the proposal of one disseminator from the proposals presented at the hearing and submit to the Board the name of that disseminator as its recommendation.


The Board may accept or reject the recommendation of the hearing panel. If the Board rejects the recommendation, it may select any other disseminator who presented a proposal at the hearing, or may reject all proposals presented at the hearing.


The Commission, with the advice and assistance of the Board, shall adopt regulations prescribing the information and documentation each disseminator must include in his or her proposal.
