Holding of remains awaiting cremation.

If the operator of a crematory cannot cremate human remains immediately after receiving them, the operator shall place them in a holding facility within or adjacent to the crematory which:

Preserves the dignity of the remains;

Protects for the health and safety of employees of the operator; and

Is secure from access by anyone other than those employees, except a laborer in the ordinary course of his or her work.

If human remains are not embalmed, they may not be held longer than 24 hours unless the holding facility is refrigerated.

An operator need not accept for holding a container from which there is any evidence of leakage of bodily fluids.
