Transfer of child to out-of-state facility

  • inspection of facility and interview of child required.

1.

Before or at the time the Division transfers a child who has been committed to the custody of the Division to a facility located outside this State, the Administrator or the designee of the Administrator shall physically inspect the facility to determine whether the facility:

(a)

Provides the services or treatment necessary for the child;

(b)

Is either accredited or licensed and in good standing with the entity which accredits or licenses the facility; and

(c)

Is subject to health inspections and the results of any such health inspections conducted within the immediately preceding 3 years.

2.

If a child is placed in a facility that is located outside this State, the Administrator of the Division or the designee of the Administrator shall, at least one time each year, to ensure the continued appropriateness of the placement:

(a)

Physically inspect the facility;

(b)

Review the services being provided to the child at the facility and any treatment plan established for the child; and

(c)

Interview the child.

3.

The provisions of this section apply to any child committed to the custody of the Division pursuant to title 5 of NRS, chapter 432B or 433B of NRS or pursuant to any other authority.
