Genetics program: Qualifications of personnel

  • exemption.

1.

The genetics program must include a geneticist and a cytogeneticist and such other personnel as determined by the Board of Regents and the Division of Public and Behavioral Health of the Department of Health and Human Services.

2.

Except as otherwise provided in subsection 3:

(a)

The clinical services provided by the genetics program must be supervised by a geneticist who is certified or eligible to be certified by the American Board of Medical Genetics and who is a physician licensed in this State.

(b)

A cytogeneticist employed by the genetics program must be certified or eligible to be certified by the American Board of Medical Genetics and:

(1)

Be a licensed physician; or

(2)

Have a degree of doctor of philosophy in a medical or biological science from an accredited college or university and experience in cytogenetics as approved by the University of Nevada School of Medicine.

3.

The State Board of Health may exempt a geneticist or a cytogeneticist employed by the genetics program from the requirements provided in subsection 2 upon receipt of clear and convincing evidence that hiring a geneticist or a cytogeneticist with qualifications other than those required by subsection 2 substantially complies with the intent of the law and is in the interest of the safety of the public.
