Disability retirement allowance: Cancellation.


1.

When the recipient of a disability retirement allowance is determined by the Board to be no longer disabled, the recipient’s allowance must be cancelled.

2.

A retired justice or judge who retired on account of disability whose benefit is cancelled may:

(a)

Suspend his or her monthly benefit until eligible for service retirement; or

(b)

Elect a service retirement reduced for his or her age if the justice or judge has the service credit necessary to retire.
