Disciplinary action does not preclude limitation or termination of privileges of licensee or holder of certificate or criminal prosecution

  • immunity from civil liability.

The filing and review of a complaint, its dismissal without further action or its transmittal to the Attorney General, and any subsequent disposition by the Board, the Attorney General or any reviewing court do not preclude:

Any measure by a hospital or other institution or medical society to limit or terminate the privileges of a homeopathic physician, advanced practitioner of homeopathy or homeopathic assistant according to its rules or the custom of the profession. No civil liability attaches to any such action taken without malice even if the ultimate disposition of the complaint is in favor of the homeopathic physician, advanced practitioner of homeopathy or homeopathic assistant.

2.

Any appropriate criminal prosecution by the Attorney General or a district attorney based upon the same or other facts.
