“Adverse action” defined.


1.

“Adverse action” includes:

(a)

The denial of, increase in any charge for or reduction in the amount of insurance for personal, family or household purposes;

(b)

The denial of employment or any other decision for employment purposes that adversely affects a current or prospective employee; and

(c)

An action or determination with respect to a consumer’s application for credit that is adverse to the interests of the consumer.

2.

The term does not include:

(a)

A refusal to extend additional credit under an existing credit arrangement if:

(1)

The applicant is delinquent or otherwise in default with respect to the arrangement; or

(2)

The additional credit would exceed a previously established credit limit; or

(b)

A refusal or failure at the point of sale to authorize a specific transaction on an existing account.
