Logging permit: Issuance

1.

Within 45 days after the receipt of an application for a logging permit, the State Forester Firewarden shall either:

(a)

Issue an original logging permit subject to such conditions or recommendations as the State Forester Firewarden may deem necessary; or

(b)

Deny such permit for any of the following reasons:

(1)

The applicant is not the real party in interest.

(2)

Material misrepresentation or false statement in the application.

(3)

Failure to comply with the forest practice rules or regulations.

(4)

The logging operation as planned will cause significant soil erosion and siltation.

(5)

Failure to correct a violation of a previously issued permit within a period of 3 years prior to the current application.

(6)

Inadequate performance bond.

2.

Within 10 days after the receipt of any denial, an applicant may request a hearing with the State Forester Firewarden.

3.

Upon any final denial, any performance bond shall be returned to the applicant.
