A copy of an environmental covenant must be provided by the persons and in the manner required by the agency to:
(a)
Each person who signed the covenant;
(b)
Each person holding a recorded interest in the real property subject to the covenant;
(c)
Each person in possession of the real property subject to the covenant;
(d)
Each municipality or other unit of local government in which real property subject to the covenant is located and any local planning commission whose territorial jurisdiction includes or is immediately adjacent to the real property subject to the covenant; and
(e)
Any other person the agency requires.
2.
The validity of a covenant is not affected by failure to provide a copy of the covenant as required under this section.
The legislature occasionally skips outline levels.
For example:
(3) A person may apply [...]
(4)(a) A person petitioning for relief [...]
In this example, (3), (4),
and (4)(a) are all outline levels, but
(4) was
omitted by its authors. It's only implied. This presents an
interesting challenge when laying out the text. We've
decided to display a blank section with this note, in order
to aide readability.
