  • fees for issuance and renewal of certificate.

1.

The State Board of Health shall adopt regulations governing services, including, without limitation, regulations that set forth:

(a)

Standards for the provision of quality care by a provider of services;

(b)

Requirements for the issuance and renewal of a certificate; and

(c)

The rights of consumers of services, in addition to those prescribed in this chapter, including, without limitation, the right of a consumer to file a complaint against a provider of services and the procedure for filing such a complaint.

2.

The State Board of Health may, by regulation, prescribe a fee for:

(a)

The issuance of a certificate; and

(b)

The renewal of a certificate.

3.

Any fee prescribed pursuant to subsection 2 must be calculated to produce the revenue estimated to cover the costs related to the issuance and renewal of certificates, but in no case may the fee for the issuance or renewal of a certificate exceed the actual cost to the Division of issuing or renewing the certificate, as applicable.
