Approval of preliminary plans for facilities.


1.

Before the State acting through the board, or the county, prepares or causes to be prepared plans, specifications or other documents for the construction, other acquisition, improvement or equipment of any work or other real property for the facilities of the State or the county except repairs, major renewals and major replacements, the State or the county shall submit preliminary plans to:

(a)

The Division of Environmental Protection of the State Department of Conservation and Natural Resources;

(b)

The county board of health; and

(c)

The county regional planning body,
Ê for approval of the type, scope and location of the proposed work or other real property for the facilities.

2.

Each such agency may require the State or the county to submit additional information to the agency pertaining to any such request for such approval and may require modifications to such plans as a condition of the agency’s approval.

3.

Upon the receipt of each agency’s approval in writing of such plans, the State or the county may prepare or cause to be prepared plans, specifications or other documents for the construction, other acquisition, improvement or equipment of such works or property in conformance with such approval.

4.

The county board of health shall not require any modification with which the State Environmental Commission does not concur.
