NRS 178.4715
Notification of victims upon discharge, conditional release or escape.


1.

If a person is committed to the custody of the Administrator and is subject to the provisions of NRS 178.463 to 178.471, inclusive, a victim of the person may request the Administrator or the Administrator’s designee to notify the victim of the person’s discharge, conditional release or escape from the custody of the Administrator by submitting to the Administrator:

(a)

A written request for notification; and

(b)

The current address of the victim.

2.

If the Administrator or the Administrator’s designee receives a request for notification pursuant to subsection 1, the Administrator or the Administrator’s designee shall notify the victim if the person committed to the custody of the Administrator:

(a)

Will be discharged or conditionally released pursuant to NRS 178.463 to 178.471, inclusive, at least 10 days before the discharge or release; or

(b)

Has escaped from the custody of the Administrator.

A person described in subsection 1 must not be discharged or released from commitment, temporarily or otherwise, for any purpose unless notification of the discharge or release has been mailed to the last known address of every victim of the person who has requested notification pursuant to subsection 1.

The Administrator or the Administrator’s designee may not be held responsible for any injury proximately caused by the failure to give any notice required pursuant to this section if no address was provided to the Administrator or the Administrator’s designee or if the address provided is inaccurate or not current.

5.

All personal information, including, but not limited to, a current or former address, which pertains to a victim and which is received by the Administrator or the Administrator’s designee pursuant to this section is confidential.

6.

As used in this section, “victim” means:

(a)

A person, including, without limitation, a governmental entity, against whom an act has been committed for which the person committed to the custody of the Administrator has been charged;

(b)

A person who has been injured or killed as a direct result of the commission of an act for which the person committed to the custody of the Administrator has been charged; or

(c)

A relative of a person described in paragraph (a) or (b). For the purposes of this paragraph, a “relative” of a person includes:

(1)

A spouse, parent, grandparent or stepparent;

(2)

A natural born child, stepchild or adopted child;

(3)

A grandchild, brother, sister, half brother or half sister; or

(4)

A parent of a spouse.
