Standards for and regulation of child-placing agencies

  • regulation of agencies which provide child welfare services
  • regulation of adoption or placement of children.

1.

The Division shall:

(a)

Establish reasonable minimum standards for child-placing agencies.

(b)

In consultation with each agency which provides child welfare services, adopt:

(1)

Regulations concerning the operation of an agency which provides child welfare services and child-placing agencies.

(2)

Regulations establishing the procedure to be used by an agency which provides child welfare services and a child-placing agency in placing children for adoption, which must allow the natural parent or parents and the prospective adoptive parent or parents to determine, by mutual consent, the amount of identifying information that will be communicated concerning each of them.

(3)

Any other regulations necessary to carry out its powers and duties regarding the adoption of children or the placement of children for adoption or permanent free care, including, without limitation, such regulations necessary to ensure compliance with the provisions of this chapter and any regulations adopted pursuant thereto.

2.

Each agency which provides child welfare services and child-placing agency shall conform to the standards established and the regulations adopted pursuant to subsection 1.
