Modification or termination: Conditions

1.

An agreement that provides for postadoptive contact entered into pursuant to NRS 127.187 may only be modified or terminated by an adoptive parent petitioning the court that entered the order or decree which included the agreement. The court may grant a request to modify or terminate the agreement only if:

(a)

The adoptive parent petitioning the court for the modification or termination establishes that:

(1)

A change in circumstances warrants the modification or termination; and

(2)

The contact provided for in the agreement is no longer in the best interests of the child; or

(b)

Each party to the agreement consents to the modification or termination.

2.

If an adoptive parent petitions the court for a modification or termination of an agreement pursuant to this section:

(a)

There is a presumption that the modification or termination is in the best interests of the child; and

(b)

The court may consider the wishes of the child involved in the agreement.

3.

Any order issued pursuant to this section to modify an agreement that provides postadoptive contact:

(a)

May limit, restrict, condition or decrease contact between the parties involved in the agreement; and

(b)

May not expand or increase the contact between the parties involved in the agreement or place any new obligation on an adoptive parent.
